1. Who we are

XYNTRA Holdings Limited, company number 17184090, of 71-75 Shelton Street, London, WC2H 9JQ, United Kingdom, is responsible for the Get Up and Move website and App. In this Notice, “XYNTRA”, “we”, “us” and “our” refer to XYNTRA Holdings Limited. You can contact us at support@xyntra-ai.com.

2. What this Notice covers

This Privacy Notice explains how we use personal information when you visit the Get Up and Move website, request the free App download, choose to receive marketing emails, contact us for support or use the current offline Windows desktop App.

The current Windows desktop App works offline, does not require an account and does not send personal data, usage information, analytics or crash reports to XYNTRA. Information collected through the website or by email is separate from information stored locally by the App.

3. Information collected through the website

When you visit the website, we and our website service providers may process limited technical information needed to display, secure and operate it. This may include:

  • your IP address;
  • browser and device type;
  • the date and time of the request;
  • pages or resources requested;
  • cookie or privacy choices; and
  • technical, security and error-log information.

We use this information to deliver the website, prevent misuse, maintain security, diagnose technical problems and keep the service reliable. We do not currently use this information for behavioural advertising or user profiling. Further information about cookies and similar technologies is provided in our Cookie Notice.

4. Requesting the free download

When you enter your email address to request the free Get Up and Move download, we collect your email address and information generated by the submission, such as its date and time and basic delivery or security records.

We use this information to process your request, send the download link, deal with delivery problems, prevent misuse of the form and maintain appropriate records. Providing an email address for the download does not automatically subscribe you to marketing emails.

We process this information because it is necessary to take steps at your request and for our legitimate interests in providing the requested download securely and reliably.

5. Optional marketing emails

If you separately select the optional marketing consent box, we will use your email address to send occasional Get Up and Move tips, product updates and news from XYNTRA Holdings Limited. Our lawful basis for this use is your consent.

We keep a record of the consent wording, and when and how consent was given, so that we can manage your preferences and demonstrate that consent was obtained.

You can withdraw your consent at any time by using the unsubscribe link in a marketing email or by contacting support@xyntra-ai.com. Withdrawing consent does not affect the lawfulness of marketing sent before withdrawal. After you unsubscribe, we may retain a minimal suppression record so that we do not accidentally contact you again for marketing.

6. Information stored locally by the App

The App stores a small settings file locally on your computer so that its functions and preferences operate correctly. Depending on the version and settings used, this file may contain:

  • the current calendar date;
  • the number of longer work sessions used during that day;
  • the version of the wellbeing disclaimer that you acknowledged; and
  • the date and time when you acknowledged it.

This information remains on your computer and is not sent to or accessible by XYNTRA through the App. It is used only to operate the App, apply limits relating to longer work sessions and remember that you acknowledged the current wellbeing disclaimer.

The App does not record or verify whether you stand up, complete a suggested movement, dismiss a suggestion or follow a reminder. It does not create a health, fitness, activity or productivity profile about you.

7. No App account or tracking

The current App does not require registration or a user account and does not provide social sign-in or cloud synchronisation. It does not use advertising identifiers, behavioural advertising or remote analytics. The App does not access the contents of your personal files or monitor your activity in other applications.

8. Contact and support

If you contact us by email or through another support channel, we may receive the information you choose to provide. This may include your name, email address, message, attachments and technical information about your computer, browser, website experience or the App.

We use this information to respond to your enquiry, investigate technical problems, provide support, protect the security of our services and maintain appropriate records of our correspondence.

Depending on the circumstances, we rely on steps taken at your request, performance of an agreement, compliance with legal obligations or our legitimate interests in supporting and securing our products.

9. Sharing and service providers

We may use trusted service providers to host and secure the website, operate the email form, send download and marketing emails, manage unsubscribe requests, provide communications or customer support, and store appropriate business records. These providers may process personal information on our behalf only for the services they provide to us and subject to appropriate contractual and security requirements.

We may also disclose information where required by law, to establish or defend legal rights, to protect users or our services, or in connection with a genuine corporate reorganisation, sale or transfer. We do not sell personal information.

10. International transfers

Some service providers used for website hosting, email delivery, communications, security or customer support may process personal information outside the United Kingdom or the country in which you live.

Where data-protection law requires safeguards for an international transfer, we use an appropriate lawful mechanism. This may include an applicable adequacy decision, approved contractual clauses or another legally recognised safeguard. You may contact us for further information about safeguards relevant to your personal information.

11. How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including to meet legal, accounting, security and dispute-resolution requirements.

An email address supplied only to receive the download is kept only as long as needed to send the link, deal with delivery problems, prevent misuse and maintain necessary records, after which it is deleted or anonymised unless another lawful reason applies. Marketing information is kept until you unsubscribe or withdraw consent, subject to retaining a minimal suppression and consent record where necessary.

Website security logs and support correspondence are kept only for periods proportionate to their security, support, record-keeping and legal purposes.

Locally stored App settings remain on your computer until they are cleared or removed through your computer or application controls.

12. Your rights

Depending on where you live and subject to applicable legal conditions and exemptions, you may have the right to:

  • request access to personal information we hold about you;
  • ask us to correct inaccurate or incomplete information;
  • ask us to delete your personal information;
  • ask us to restrict how your information is used;
  • object to processing based on legitimate interests;
  • object at any time to the use of your information for direct marketing;
  • receive certain information in a portable format; and
  • withdraw consent where processing is based on consent.

These rights apply to personal information held or controlled by XYNTRA. They do not apply to settings stored only on your computer that XYNTRA cannot access. To exercise a right, contact support@xyntra-ai.com. We may ask for information reasonably necessary to verify your identity and understand your request.

You also have the right to complain to a data-protection authority. In the United Kingdom, this is the Information Commissioner’s Office. If you are in the European Economic Area, you may complain to the supervisory authority in the country where you live, work or believe a data-protection infringement occurred.

13. Deleting local App settings

You can uninstall the App using the standard application-management controls provided by Windows. Depending on the App version and your computer settings, uninstalling may not automatically remove every locally stored settings file.

Any remaining local settings can be removed using the ordinary file and application-data controls provided by Windows. Because these settings remain on your computer and are not transmitted to XYNTRA, we cannot view, retrieve or delete them remotely.

14. Future versions

This Privacy Notice applies to the current website and App and to future updates that do not materially change how personal information is processed.

We may introduce new platforms, versions or features, including mobile applications, user accounts, synchronisation or connected services. Where a new feature processes additional personal information, we will provide relevant privacy information within the feature, during registration or at the point where information is collected.

15. Changes and contact

We may update this Privacy Notice to reflect a material change in our processing, a significant change to the website or App, or a change in applicable legal requirements. The current version will be made available through the website, the App or the location from which the App is distributed. The date and version number at the beginning identify the applicable version.
